Maryland cannabis laws 2026 can confuse people, even in states where adult-use cannabis is fully legal. Here’s where Maryland stands in 2026, written plainly, from a Delmar dispensary that follows these rules every day.

Who can legally buy

Finding a licensed Eastern Shore dispensary just depends on the state. Cannabis is legal in Maryland for adults 21 and over, and has been since July 2023. Anyone 21+ with a valid government-issued photo ID can purchase from a licensed dispensary. Driver’s license, state ID, passport, or military ID all work.

You do not need to be a Maryland resident. That matters a lot along the Delmarva line, where a meaningful share of our customers drive in from Delaware or Virginia. Maryland also runs a separate medical program for registered patients, with its own registration process through the state.

How much you can buy

In a given day, Maryland limits you to 1.5 ounces of flower (pre-rolls included), 12 grams of concentrate (vapes, wax, shatter, resin and similar), or 750 mg of total THC in other products like edibles, or an equivalent mix.

One detail people get wrong: this is a per-customer daily cap tracked through the state’s system, not a per-transaction one. Buying at two different dispensaries on the same day doesn’t give you two allowances.

What you can possess

Those same figures are the legal possession limits for adults 21+. Going over carries real consequences. Between 1.5 and 2.5 ounces is a civil offense with a fine up to $250. Above 2.5 ounces becomes a misdemeanor.

What you’ll pay in tax

Adult-use cannabis in Maryland carries a 12% sales and use tax, raised from the original 9% effective July 1, 2025. Registered medical patients are taxed differently. For comparison, Delaware taxes adult-use cannabis at 15%.

Growing at home

Adults 21+ may grow up to two cannabis plants per household for personal use. That’s per household, not per adult, so two roommates who are both 21 still get two plants total between them. Registered medical patients may grow up to four. Plants have to be out of public view and secured against access by anyone under 21, and if you rent, you need written permission from the property owner.

What’s still off the table

Public consumption is not legal; use is restricted to private property. Driving under the influence of cannabis is illegal and enforced the way alcohol impairment is. Transporting cannabis across state lines is a federal offense even between two legal states. And cannabis remains illegal under federal law generally, which matters on federal land and property.
